Terms and Conditions
STANDARD TERMS AND CONDITIONS OF SALE
- All prices quoted by INTERCONTINENTAL CABLES LTD, or shown on invoices, sales acknowledgements etc. are valid only at the time of issue, unless validity is expressed in writing by INTERCONTINENTAL CABLES LTD.
- Payment of invoices whether for part shipment or the entire order shall be made in accordance with the credit terms detailed on the invoice.
- INTERCONTINENTAL CABLES LTD reserves the right to deliver and invoice for 5% more or less than the quantity ordered.
- All special constructions or items supplied in accordance with the BUYERS specifications are regarded as non-cancellable and non-returnable.
- All materials remain the property of INTERCONTINENTAL CABLES LTD, whether in transit or in the BUYERS premises, or in any place where the BUYER is conducting his business, until paid for in full. Until the materials are paid for in full INTERCONTINENTAL CABLES LTD reserves the right to demand their return; where the BUYER is unable to identify the materials INTERCONTINENTAL CABLES LTD reserves the right to take products from the BUYER to the value of the original material.
- In the event of the BUYERS failure to make payment for materials supplied by INTERCONTINENTAL CABLES LTD, or if the BUYER becomes bankrupt, goes into liquidation, or appoints a receiver INTERCONTINENTAL CABLES LTD or their appointed representatives shall be allowed to enter the BUYERS premises to reclaim products as detailed in paragraph 5.
- INTERCONTINENTAL CABLES LTD accepts no responsibility, domestic or foreign, arising from the use or misuse of materials supplied to the BUYER. INTERCONTINENTAL CABLES LTD shall not be liable for any infringement of patent resulting from the use of any supplied material in any product.
- INTERCONTINENTAL CABLES LTD endeavour to ensure that all products are free from defects in both material and workmanship, and will take steps to replace any goods found to be faulty due to the manufacturing process. In the event of disagreement INTERCONTINENTAL CABLES LTD reserve the right to make the final decision regarding necessary action in any case.
- All breakages, shortages, errors and discrepancies must be notified in writing to INTERCONTINENTAL CABLES LTD within seven days of receipt of goods, after which time no claims can be accepted.
- INTERCONTINENTAL CABLES LTD does accept no responsibility for consequential damage, loss or expense arising from the use, sale or resale of any material supplied by the Company.
- The BUYER takes full responsibility for the suitability of any product or material for his use. INTERCONTINENTAL CABLES LTD may recommend or advise on suitable products but the final decision lies with the BUYER.
- INTERCONTINENTAL CABLES LTD accepts no responsibility for any expense loss or consequential damages arising from late or damaged shipments.
- INTERCONTINENTAL CABLES LTD reserve the right to cancel the BUYERS order in whole or part, without liability, where completing said order would be against the interests of INTERCONTINENTAL CABLES LTD.
- INTERCONTINENTAL CABLES LTD can accept no responsibility for any loss, expense or consequential damage incurred as a result of events which are outside our control, for example natural disasters, acts of God and civil unrest.
- In any event INTERCONTINENTAL CABLES LTD total liability shall not exceed the invoiced price of any products or materials deemed to be defective.
- Should it be necessary to return material samples for inspection or evaluation, clearance must first be obtained from INTERCONTINENTAL CABLES LTD so that arrangements can be made to handle the material.
- In the event of any disagreement between the BUYER`S terms and conditions of sale and those laid out herein INTERCONTINENTAL CABLES LTD terms and conditions will prevail.
